PRIVACY POLICY

Stayability ("Stayability," "Company," "we," "us," or "our") is operated by Stayability USA LLC. We respect your privacy and are committed to protecting personal information.
This Privacy Policy explains how we collect, use, disclose, and safeguard personal information when you access or use the Stayability website, booking platform, verification services, messaging tools, property listings, and related services (collectively, the "Platform").
1. INFORMATION WE COLLECT
The information we collect depends on how you interact with the Platform.
A. Information You Provide
We may collect information that you provide directly to us, including:
- Name
- Email address
- Phone number
- Mailing address
- Account credentials
- Profile information
- Profile photographs
- Property listing information
- Property descriptions
- Property photographs and videos
- Accessibility-related property information and questionnaire responses
- Reservation and booking-related information
- Reviews and ratings
- Customer support inquiries
- Messages and communications
- Information submitted through forms, surveys, or other communications
B. Host Information
Hosts and property managers may provide information including:
- Property ownership or management information
- Property addresses and general location information
- Availability calendars
- Pricing information
- Property rules and policies
- Accessibility-related property features
- Measurements
- Verification documentation
- Property photographs and videos
- Information necessary to operate and manage listings and reservations
Hosts are responsible for ensuring that they have the right to provide information, photographs, videos, and other materials submitted to Stayability.
C. Guest Information
Guests may provide information including:
- Reservation or booking-related information
- Saved properties and favorites
- Reviews and ratings
- Communications with hosts
- Customer support requests
- Information voluntarily provided regarding accessibility or accommodation needs
Stayability does not require guests to provide a medical diagnosis or detailed medical history to use the Platform. Guests may voluntarily disclose accessibility or accommodation needs when communicating with hosts or Stayability.
Users should avoid providing sensitive medical or health information unless reasonably necessary for a specific request or communication.
D. Communications Information
Stayability provides messaging tools that allow users to communicate through the Platform.
When users communicate through the Platform, we may collect and store:
- Messages between hosts and guests
- Customer support communications
- Booking-related communications
- Attachments, photographs, files, and documents shared through the Platform
We may access, review, or use communications when reasonably necessary to provide Platform functionality, provide customer support, investigate suspected fraud or policy violations, resolve disputes, protect users, enforce our Terms of Service or other policies, or comply with legal obligations.
Users should avoid including unnecessary sensitive personal information in messages or attachments.
E. Payment and Transaction Information
Stayability uses or may use Stripe and other third-party payment service providers to facilitate payments, transactions, and host payouts.
Depending on the transaction and services being used, these providers may collect information such as:
- Payment card or bank account information
- Billing information
- Transaction information
- Identity-verification information where required by the payment provider
- Information necessary to process host payouts
Stayability does not store complete payment card numbers on its own servers.
Payment and financial service providers process information in accordance with their own terms, privacy policies, and legal obligations.
Stayability may receive transaction-related information from payment processors, including payment status, payout status, transaction identifiers, limited payment details, fraud indicators, chargeback information, and other information reasonably necessary to administer reservations, payments, refunds, disputes, and payouts.
Stayability does not independently require users to submit government-issued identification unless such verification becomes reasonably necessary for a particular Platform function or legal requirement. Third-party payment or service providers may independently require identity verification in accordance with their own requirements.
F. External Booking Pages
Stayability may allow users to access a host’s or third party’s external booking website or booking page to complete a reservation.
When a user leaves the Stayability Platform and provides information directly to a host, booking provider, payment provider, or other third-party website, the collection and use of that information may be governed by that third party’s privacy policy and terms.
Stayability is not responsible for the privacy practices of third-party websites or services.
Stayability may also facilitate reservations and payments directly through the Platform as those services become available. Information collected through direct Stayability bookings will be handled in accordance with this Privacy Policy.
G. Virtual Verification Information
Stayability provides virtual accessibility verification services for participating properties.
The verification process may include:
- Accessibility questionnaire responses
- Property photographs
- Property videos
- Measurements
- Notes and observations
- Verification documentation
- A live virtual video walkthrough, when needed or required
Stayability reviews this information to evaluate accessibility-related property features and determine applicable verification status, tiers, and/or accessibility badges.
Stayability does not ordinarily record or retain live virtual walkthroughs or screenshots from those walkthroughs. In limited circumstances, information from a walkthrough may be documented or retained when reasonably necessary for verification, quality control, dispute resolution, fraud prevention, legal compliance, or another legitimate Platform purpose.
Stayability does not conduct an in-person inspection as part of its standard virtual verification process unless expressly stated for a particular property.
H. Information From Third Parties
We may receive information from third parties when reasonably necessary to operate the Platform, including:
- Payment processors
- Hosts and property managers
- Service providers
- Fraud-prevention or security providers
- Analytics or technology providers
In the future, Stayability may also receive property accessibility or verification information from third-party accessibility or verification organizations. If such information is displayed on the Platform, it may be identified as originating from a third party where appropriate.
I. Automatically Collected Information
When you use the Platform, we or service providers that support the Platform may automatically collect certain technical information, which may include:
- IP address
- Browser type
- Device type
- Operating system
- Referral source
- Pages viewed
- Search activity
- Clickstream information
- Date and time of access
- Platform interactions
- Error and performance information
Stayability does not currently require users to provide precise GPS or device-location information to use the Platform.
Property addresses and general property locations provided in connection with listings are separate from a user’s device location.
2. COOKIES AND SIMILAR TECHNOLOGIES
Stayability and service providers that support the Platform may use cookies and similar technologies as necessary to operate the Platform, remember user preferences, maintain account sessions, understand Platform usage, improve functionality and performance, and help prevent fraud or abuse.
As our Platform develops, we may also use analytics or similar technologies to understand how users interact with Stayability.
Where required by applicable law, we will provide users with appropriate choices concerning non-essential cookies or certain uses of personal information.
Browser settings may allow users to block or delete certain cookies. Disabling cookies may cause portions of the Platform to function differently or become unavailable.
3. HOW WE USE INFORMATION
We may use personal information to:
- Create and manage accounts
- Authenticate users
- Publish and manage property listings
- Operate property search and discovery features
- Facilitate reservations and booking-related activities
- Facilitate communication between hosts and guests
- Process or facilitate transactions, refunds, and host payouts when applicable
- Conduct virtual verification services
- Evaluate accessibility-related property features
- Display accessibility-related property information
- Assign and maintain verification status, tiers, and badges
- Provide customer support
- Communicate about accounts, listings, reservations, verification, and Platform services
- Send necessary administrative and service-related notices
- Detect and prevent fraud, abuse, and security incidents
- Investigate disputes, chargebacks, complaints, and suspected policy violations
- Enforce our Terms of Service and other Platform policies
- Protect users and the integrity of the Platform
- Improve and develop the Platform and our services
- Analyze Platform usage and performance
- Maintain business and transaction records
- Comply with legal, regulatory, tax, and accounting requirements
- Establish, exercise, or defend legal claims
- Protect the rights, property, safety, and security of Stayability, our users, and others
We may also use information for other purposes disclosed to you when the information is collected or with your consent.
4. HOW WE DISCLOSE INFORMATION
We do not sell personal information for monetary compensation.
We may disclose personal information in the following circumstances:
A. Between Hosts and Guests
We may provide information between hosts and guests when reasonably necessary to facilitate inquiries, communications, reservations, stays, disputes, or other Platform functions.
B. Service Providers
We may disclose information to vendors and service providers that perform services on our behalf or support the Platform, including providers of:
- Website hosting and technical infrastructure
- Data storage
- Payment processing and host payouts
- Communications
- Customer support
- Analytics
- Fraud prevention and security
- Email services
- Other technology or operational services
These providers may process personal information as necessary to provide their services and subject to applicable contractual and legal obligations.
C. Verification Services
We may disclose property and verification-related information to contractors or service providers when reasonably necessary to conduct or support Stayability’s verification services.
If Stayability works with third-party accessibility or verification organizations in the future, information may also be disclosed to or received from those organizations as reasonably necessary to provide the applicable service.
D. Legal and Safety Disclosures
We may disclose information when we reasonably believe disclosure is necessary to:
- Comply with applicable law, regulation, court order, subpoena, or other legal process
- Respond to lawful requests from government or law-enforcement authorities
- Investigate fraud, security incidents, or potentially illegal activity
- Enforce our Terms of Service or other policies
- Protect the rights, property, or safety of Stayability, our users, or others
- Establish, exercise, or defend legal claims
E. Business Transactions
We may disclose or transfer information in connection with an actual or proposed merger, acquisition, financing, reorganization, sale of assets, bankruptcy, investment, or other business transaction, subject to applicable law.
F. With Your Direction or Consent
We may disclose information when you direct us to do so, request a service requiring the disclosure, or otherwise consent.
5. PUBLIC PROPERTY LISTINGS AND PROFILE CONTENT
Certain information submitted to Stayability is intended to be displayed publicly as part of a property listing or user profile.
Depending on what a host or user chooses to provide, publicly displayed information may include:
- Name or profile information
- Profile photograph
- Company or property-management information
- Property listings and descriptions
- Property photographs and videos
- Property location information
- Accessibility-related property information
- Verification status, tiers, or badges
- Reviews and ratings
- Other information submitted for public display
Information posted publicly may be viewed, copied, saved, or shared by other users or third parties outside Stayability’s control.
Users should not submit information for public display that they do not wish to make publicly available.
6. ACCESSIBILITY INFORMATION
Accessibility-related property information may originate from:
- Hosts
- Property managers
- Stayability’s virtual verification process
- Photographs
- Videos
- Measurements
- Questionnaires
- Documentation submitted to Stayability
In the future, accessibility-related information may also originate from third-party accessibility or verification organizations.
We use this information to describe property features and help guests evaluate whether a property may meet their needs.
Accessibility information concerning a property—such as entrance configuration, doorway measurements, bathroom features, or other property characteristics—is different from personal information concerning a guest’s disability, diagnosis, or health condition.
Stayability does not require guests to disclose a disability or medical diagnosis to use the Platform. If a guest voluntarily provides information concerning personal accessibility or accommodation needs, we may use that information as reasonably necessary to facilitate communications, respond to the request, provide customer support, or otherwise provide the requested service.
7. FRAUD PREVENTION, PLATFORM SAFETY, AND ENFORCEMENT
We may collect, use, retain, and disclose information as reasonably necessary to:
- Protect accounts
- Detect suspicious activity
- Prevent fraud and abuse
- Investigate chargebacks and payment disputes
- Investigate suspected violations of our Terms or policies
- Protect hosts and guests
- Protect the integrity and security of the Platform
- Enforce account restrictions, suspensions, or terminations
This may include reviewing account activity, transactions, listings, communications, verification materials, and information received from relevant service providers.
8. COMMUNICATIONS
Stayability may send users communications reasonably necessary to operate the Platform, including:
- Account communications
- Listing-related communications
- Verification communications
- Reservation or booking-related communications
- Customer support responses
- Security notices
- Policy or legal notices
- Important service updates
Stayability does not currently use account information for routine promotional email or text-message marketing. If our marketing practices change, we may update this Privacy Policy and provide any choices required by applicable law.
9. DATA RETENTION
We retain personal information for as long as reasonably necessary for the purposes for which it was collected, including to:
- Provide the Platform and services
- Maintain accounts and transaction records
- Facilitate reservations and payouts
- Maintain appropriate verification records
- Resolve disputes
- Investigate fraud or policy violations
- Process or defend against chargebacks
- Enforce agreements
- Establish, exercise, or defend legal claims
- Comply with tax, accounting, regulatory, and other legal obligations
Retention periods may vary depending on the type of information, the nature of our relationship with the user, and applicable legal requirements.
When information is no longer reasonably necessary, we may delete or de-identify it, subject to applicable law and legitimate business requirements.
Certain information may remain in backups or archival systems for a limited period after deletion from active systems.
10. ACCOUNT CLOSURE AND DELETION REQUESTS
Users who wish to close their account or request deletion of personal information may contact Stayability using the contact information below.
Closing an account or submitting a deletion request does not necessarily result in immediate deletion of all information associated with the account.
We may retain information where reasonably necessary or permitted by law for purposes including legal compliance, fraud prevention, dispute resolution, transaction records, chargebacks, enforcement of agreements, protection of users, or establishment or defense of legal claims.
Public content previously submitted by a user may continue to appear where reasonably necessary to preserve transaction history, reviews, records, or Platform integrity, subject to applicable law and our Terms of Service.
Our rights concerning user-submitted content are also governed by the Terms of Service.
11. DATA SECURITY
We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure.
However, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.
Users are responsible for maintaining the confidentiality of their account credentials and should notify Stayability if they believe their account has been accessed without authorization.
12. YOUR PRIVACY RIGHTS AND CHOICES
Depending on where you reside and subject to applicable law, you may have rights concerning your personal information, which may include the right to:
- Request access to personal information we maintain about you
- Request information about how we collect, use, or disclose personal information
- Request correction of inaccurate personal information
- Request deletion of certain personal information
- Obtain a portable copy of certain personal information
- Opt out of certain uses or disclosures of personal information, where applicable
- Opt out of certain targeted advertising, sale, or sharing of personal information, where applicable
- Withdraw consent where processing is based on consent and applicable law permits withdrawal
- Appeal certain decisions concerning a privacy request, where required by applicable law
- Exercise applicable privacy rights without unlawful discrimination or retaliation
These rights are not absolute. Applicable law may permit or require us to retain or continue using certain information despite a request.

We may need to verify your identity before completing certain requests. Any verification information will be used for purposes reasonably related to verifying and processing the request.
Where permitted by applicable law, an authorized agent may submit certain requests on a user’s behalf. We may require reasonable proof of the agent’s authority and/or verification directly from the user.
If applicable law gives you a right to appeal our decision concerning a privacy request, you may submit an appeal using the same contact information and identifying the request as a Privacy Appeal.
13. SALE, SHARING, AND TARGETED ADVERTISING
Stayability does not sell personal information for monetary compensation.
Certain privacy laws may define “sale,” “sharing,” or “targeted advertising” more broadly than an exchange of information for money.
Where required by applicable law, Stayability will provide applicable privacy choices and opt-out mechanisms based on the technologies and services used by the Platform.
14. SENSITIVE PERSONAL INFORMATION
Certain information may be considered sensitive personal information or sensitive data under applicable privacy laws.
Stayability seeks to limit the collection of sensitive personal information to information reasonably necessary to provide the Platform, process transactions, maintain security, comply with law, or respond to a user’s request.
Stayability does not require guests to provide detailed medical histories or diagnoses to use the Platform. Guests should avoid providing unnecessary sensitive health information.
Where applicable law requires consent or provides additional rights concerning sensitive personal information, we will process such information in accordance with those requirements.
15. THIRD-PARTY SERVICES
The Platform may contain links to or integrate with third-party websites and services, including:
- Host booking websites or booking pages
- Payment and financial service providers, including Stripe
- Property management or calendar services
- Hosting and technology providers
- Other third-party businesses or services
Third parties may collect information directly from users under their own privacy policies and terms.
When users follow a link from Stayability to a third-party website, information provided on that website is generally collected by the applicable third party rather than Stayability unless otherwise disclosed.
Stayability is not responsible for the privacy practices of third parties, and users should review the privacy policies of third-party services they use.
16. CHILDREN’S PRIVACY
The Platform is not directed to children under 13, and Stayability does not knowingly collect personal information directly from children under 13.
Users must be at least 18 years old and have the legal capacity to enter into a binding contract to create an account or make a reservation through the Platform.
If we learn that we have knowingly collected personal information directly from a child under 13 in circumstances prohibited by applicable law, we will take reasonable steps to delete it.
17. STATE-SPECIFIC PRIVACY RIGHTS
Residents of certain U.S. states may have additional privacy rights under applicable state law.
The availability and scope of these rights depend on the user’s state of residence, the nature of the information involved, and whether the applicable law applies to Stayability.
Where a state privacy law applies to Stayability, we will process eligible privacy requests and provide required rights and disclosures in accordance with that law.
Nothing in this Privacy Policy is intended to limit rights that cannot legally be limited or waived.
18. CHANGES TO THIS PRIVACY POLICY
We may modify this Privacy Policy from time to time to reflect changes in our services, technology, business practices, or legal requirements.
When we make changes, we will post the updated Privacy Policy and revise the Effective Date.
Where required by applicable law, we may provide additional notice of material changes.
